These terms apply to mynewzealand.co.nz, operated by My New Zealand. They cover our digital downloads, commercial licences, merchandise links, website accounts and business directory, including the Ōmokoroa Local Business Directory.
Using the website and your account
Use the website lawfully and respectfully. Do not submit misleading information, infringe another person’s rights, send spam, introduce harmful software or attempt to access another person’s account. Keep your account details accurate and your password private. Contact us if you suspect unauthorised use.
Your My New Zealand account can provide access to purchased downloads and orders, as well as your business listings. Access to a particular download depends on the purchase and any download limits or expiry stated for that product.
Digital downloads
Digital products are downloadable files; no physical item is supplied unless the product description expressly says otherwise. Check the product description for the included formats and what you need to use them. You are responsible for checking compatibility with your software or equipment before buying.
After successful payment, downloads are provided through the order or account process. If a file is missing, damaged, inaccessible or does not match its description, contact mynewzealandart@gmail.com so we can help.
Artwork and personal use
Copyright in our artwork remains with My New Zealand or the relevant rights holder. Buying a download gives you permission to use it within the applicable licence; it does not transfer copyright.
Unless the product includes commercial permission or you purchase the relevant commercial licence, downloads are for personal use. You must not resell, distribute or share the files, or make them available for others to download.
Commercial licences
To use our designs on products you produce for commercial sale, you need one commercial licence for each design. Identify the design when purchasing the licence. The commercial licence product page sets out the licence conditions.
- You may use the licensed design on physical products you produce for sale within those conditions.
- You must not resell or distribute the artwork files, including SVG, DXF, PNG or any other file type.
- You must not use the files as part of a new design sold in digital form.
- Products must not allow third parties to easily extract the artwork files or resources.
- You must not upload or use the designs on services such as Redbubble, Zazzle, Amazon Merch or similar sites.
A commercial licence does not transfer ownership of the artwork or give exclusive rights. If you are unsure whether a proposed use is permitted, contact us before using the design.
Prices, payment and consumer rights
Product prices and the applicable currency are shown during purchase. Any applicable taxes or other charges are shown at checkout. Successful payment is required before paid downloads or licences are provided.
Because digital files can be downloaded immediately, we do not normally offer refunds simply because you change your mind. This does not limit your rights if a product is faulty, misdescribed or otherwise fails to meet applicable consumer guarantees. Contact us with your order details if something is wrong.
Nothing in these terms excludes or restricts rights or remedies that cannot lawfully be excluded under New Zealand’s Consumer Guarantees Act, Fair Trading Act or other applicable law.
Merchandise and external websites
Some merchandise is sold through external websites such as Redbubble. A “Buy on Redbubble” button takes you to that website, where its seller and platform handle the purchase, payment, production, delivery, returns and customer service under their own terms. Our digital-download and commercial-licence permissions do not automatically apply to an external merchandise purchase.
Other external links, including business websites and affiliate links, lead to independently operated websites. Where an affiliate commission may be earned, we identify the affiliate link.
Using the business directory
The directory helps people discover businesses, trades and services. Listed businesses operate independently of My New Zealand. A listing is not an endorsement or a guarantee of qualifications, availability, pricing or workmanship.
Check important details directly with the business before booking, buying or engaging its services. Any agreement for those services is between you and that business. Tell us if you notice an inaccurate or inappropriate listing.
Submitting and maintaining a listing
You must be authorised to represent the business you submit. Keep its description, contact details, service areas and links accurate and current. Only submit images, logos and other content you own or have permission to use, and contact details you are authorised to publish.
You retain ownership of your submitted content. By submitting it, you give My New Zealand permission to display, format and make reasonable editorial adjustments to it for operating and promoting the directory. This permission is limited to those purposes.
Some listings may be created from publicly available business information. An authorised business representative can contact us to request a correction or removal. Publishing a listing does not mean the business has personally submitted or endorsed it.
Moderation and directory availability
We may decline, edit or remove listings that are inaccurate, duplicated, misleading, unlawful, infringing, abusive or unrelated to the directory. We may restrict accounts used to misuse the website. We do not guarantee a particular search position, number of views, enquiries or sales.
Any optional paid listing or promotional service will have its price and conditions explained before you agree to purchase it. A free listing does not create an obligation to buy an upgrade.
Privacy
Our Privacy Policy explains how we handle purchase, account and listing information. Published business details are public and may be indexed by search engines or shared by visitors.
Website information and responsibility
We take reasonable care with the website, but information can become outdated and technical interruptions can occur. We do not promise uninterrupted access. We remain responsible for our own obligations under applicable law; the independent operation of a listed business does not remove those obligations.
Changes and contact
We may update these terms as the website changes. Updates apply to future use and purchases and do not retrospectively remove rights attached to an existing purchase or licence. These terms are governed by New Zealand law, without excluding any mandatory consumer rights that apply to you.
